Derecho constitucional y derecho económico, un vínculo indisoluble
Los regímenes jurídicos están integrados por sistemas normativos en el campo admi nistrativo, civil, penal, laboral u otras disciplinas vinculadas al derecho constitucional, en cuyo marco se define la estructura de los países, y sobre las que el legislador impul sa nuevas leyes o plantea una serie de reformas a las puestas en vigencia. Sin embar go, el desarrollo de un determinado proceso constituyente no solo abarca aspectos referidos a la manera de organizar el aparato público y garantizar su funcionamiento, también suele advertirse una alineación de orden económico que origina principios, derechos, deberes y demás elementos contenidos en la Ley Fundamental, lo que da lugar al surgimiento del denominado derecho constitucional económico. El presente artículo analiza preceptos económicos insertos en textos de la Norma Suprema, junto a las cláusulas que garantizan el ejercicio de los derechos económicos, explicando así las relaciones existentes entre el derecho constitucional y el derecho económico.

Constitutional law and economic law, an indissoluble connection
Legal systems comprise regulatory systems in the administrative, civil, criminal, and labor spheres or other disciplines associated with constitutional law, which provide the framework that defines a country’s structure, and are the foundation on which the legislator promotes new laws or proposes a series of reforms to existing laws. However, the development of any particular constitution-making process not only encompasses questions related to the manner of organizing the public apparatus and guaranteeing its operation, but also often involves an economic alignment that gives rise to principles, rights, duties, and other elements contained in the Constitution, from which what is known as constitutional economic law emerges. This article analyzes economic precepts embedded in the texts of the Constitution, together with the clauses that guarantee the exercise of economic rights, thus explaining the relationship between constitutional law and economic law.

Verfassungsrecht und Wirtschaftsrecht, eine unauflösliche Verbindung
Rechtssysteme bestehen aus Normensystemen auf den Gebieten des Verwaltungs-, Zivil-, Straf- und Arbeitsrechts sowie weiterer mit dem Verfassungsrecht verbundener Rechtsgebiete, auf deren Grundlage die Struktur der Staaten definiert wird und der Gesetzgeber Gesetzesvorhaben vorlegt oder Novellierungen bestehender Vorschrif ten vorschlägt. Ein Verfassungsgebungsprozess umfasst jedoch nicht nur Aspekte, die die Organisation des Staatsapparats und die Sicherstellung seiner Tätigkeit betreffen; vielmehr lässt sich auch eine Ausrichtung der Wirtschaftsordnung an den Grund sätzen, Rechten, Verpflichtungen und sonstigen, in der Verfassung niedergelegten Elementen feststellen, die zur Entstehung des sogenannten Wirtschaftsverfassungs rechts führen. Der vorliegende Artikel befasst sich sowohl mit den im Text der obers ten Rechtsnorm enthaltenen Wirtschaftsgrundsätzen als auch mit den Klauseln, die die Ausübung der Wirtschaftsrechte gewährleisten, und erläutert so die bestehenden Beziehungen zwischen Verfassungs- und Wirtschaftsrecht.
