La inteligencia artificial y el poder público: una mirada a su utilización como herramienta de eficiencia estatal, a partir de su impacto en los derechos humano
En el presente trabajo se realiza un análisis reflexivo mediante el uso de la metodolo gía cualitativa y el estudio de fuentes bibliográficas relevantes, sobre la utilización de la IA para la toma de decisiones en el ejercicio del poder público en Colombia, par tiendo de las ventajas y los riesgos propios de dicha tecnología disruptiva, los cuales han afectado principalmente la garantía y protección de los derechos humanos, tal como lo han evidenciado las experiencias documentadas en otros Estados, las cuales llaman a cuestionarnos si esta herramienta técnica es la idónea para tomar decisiones administrativas o judiciales y si es el momento para implementarlas.

Artificial intelligence and public power: An examination of its use as a tool for state efficiency, from the perspective of its impact on human rights
This research aims to conduct a reflective analysis of the use of AI for decision-making in the exercise of public power in Colombia, using qualitative methodology and the study of relevant bibliographic sources. The article examines the advantages and risks of this disruptive technology, which have mainly affected the guarantee and protec tion of human rights, as evidenced by experiences documented in other states, which cast doubt on whether this technical tool is suitable for administrative or judicial decision-making and whether this is the right time to implement it.

Künstliche Intelligenz und Staatsgewalt: Überlegungen zu ihrer Verwendung als Instrument staatlicher Effizienz am Beispiel ihrer Auswirkungen auf die Menschenrechte
Die vorliegende Arbeit beabsichtigt eine reflexive Analyse unter Verwendung quali tativer Methoden und der Auswertung relevanter Literaturhinweise über den Einsatz von KI zur Entscheidungsfindung im Rahmen der Ausübung der Staatsgewalt in Ko lumbien. Dabei wird von den Vorteilen und Risiken dieser destabilisierenden Techno logie ausgegangen, die vor allem die Garantie und den Schutz der Menschenrechte betreffen, wie aus den dokumentierten Erfahrungen aus anderen Staaten hervorgeht, aufgrund derer wir uns fragen müssen, ob dieses technische Instrument dazu ge eignet ist, Verwaltungs- oder Gerichtsentscheidungen zu treffen, und ob schon der Zeitpunkt gekommen ist, solche Entscheidungen umzusetzen.
